Federal Constitutional Court prohibits the Federal President from signing the Own Resources Act

Yesterday, the Bundestag approved the Own Resources Act. After that, the Federal Council still had to consent, which met today. Publicly, the impression was created that this consent would only occur at the next Federal Council meeting in May, as until yesterday, this consent was neither on the agenda of the Federal Council nor had the responsible committees dealt with the Bundestag's vote.

Should fait accompli be created?

Only a few minutes after the vote in the Bundestag, the item suddenly appeared on the agenda of today's meeting. The suspicion is close that the federal government would have liked to have the law approved expediently today by the Federal Council and then have it executed by the Federal President, so that no one could timely call the Constitutional Court.

The Federal Constitutional Court responded immediately. Already around noon, a decision was made that prohibits the Federal President from executing the ERatG before the Federal Constitutional Court has decided on our application for a temporary injunction. [Ruling of the Federal Constitutional Court of 26.3.2021]

This is a good and promising start. Alliance Citizen's Will had anticipated such plans of the government and had prepared all measures for timely legal steps in advance. Presumably, only in this way could the signature of the Federal President be prevented, which would have put the law into effect.

Unfortunately, one can no longer join the constitutional complaint, but at least 2281 people have done so and thus give the constitutional complaint significant weight.
